Birthspirit Student Complaint Resolution Process

1. If a student has a complaint about any educational service provided to her by Birthspirit, then the following process is available:

  • The student will send to Birthspirit written particulars of the complaint and a statement as to how she would like the complaint to be resolved
  • Birthspirit will promptly respond to the complaint in writing
  • If Birthspirit agrees to the resolution proposed by the student, then Birthspirit will carry that out
  • If Birthspirit does not agree to the resolution then it will try and resolve the complaint by an exchange of writing, by phone and/or face to face meeting(s)
  • If the complaint is still not resolved then Birthspirit will initiate a facilitated meeting with the student for the purpose of resolution. The facilitator, time and place of the meeting will be agreed to by Birthspirit and the student. The costs of the facilitator will be paid by Birthspirit and the student equally
  • If the facilitated meeting does not resolve the complaint then either party may refer the matter to arbitration under the provisions of the Arbitration Act 1999.

2. At all times between receiving the complaint and it’s resolution, Birthspirit agrees to:

  • Observe the principles of natural justice
  • Treat the student with dignity and respect
  • The student having a support person(s) present during the process
  • Work towards resolution in good faith

3. The complaints process above is in addition to any rights the student has under the Consumer Guarantees Act 1993.

4. Birthspirit will make a copy of the complaints process available on this website, in Birthspirit's Cottage and to students on request.
